Reminder: New Rules for Returning to Work in Retirement
August 2023
Updated return-to-work legislation took effect July 1, adding a new critical shortage position and reducing the break-in-service requirement for some roles.
Here’s a recap of what changed:
- A new critical shortage position was added. The Specialized Student Support role includes school social workers, school psychologists, school nurses, and other licensed health and behavioral positions, as determined by the Virginia Department of Education.
- The break-in-service requirement for some roles was reduced from 12 months to six months. This affects those who return to work full-time in critical shortage positions, as well as retired sworn law-enforcement officers who return to work full-time in retiree school security officer roles.
